Terms of service

The rules for using the CloudByte AI platform and this website. If you have a signed order form with us, it takes precedence where it differs.

Last updated: October 4, 2026

Agreement

These terms govern your use of the CloudByte website and of the CloudByte AI platform (the "Service"), provided by CloudByte AI ("CloudByte", "we", "us"). By creating a workspace or using the Service, you agree to these terms on behalf of yourself and the organization you represent. If you have a signed order form with us, the order form takes precedence where the two differ.

The Service

The CloudByte AI platform captures AI coding activity, token spend and git activity from developer machines through the CloudByte agent and presents it in a dashboard and API for your organization. Features differ by plan, as described on our pricing page. We may improve and change the Service over time, and we will not materially reduce the core functionality of a paid plan during a paid term.

Accounts and organizations

  • You must give accurate information when you create a workspace and keep your sign-in details secure.
  • Organization admins decide who has access and which role each person holds, and are responsible for activity under their organization.
  • Tell us promptly at hello@cloudbyte.ai if you suspect unauthorized access to your workspace.

Free plan, trials and the startup plan

The Free plan covers teams of up to 5 developers. The Starter and Team plans include a 14-day free trial with no credit card required. At the end of a trial you can subscribe to a paid plan or continue on Free within its limits.

The startup plan is available to companies that meet the eligibility criteria on our pricing page. We may ask for reasonable evidence of eligibility and may end the discount if the criteria were not met.

Fees and payment

Paid plans are billed at a flat price per plan tier, monthly or annually, at the prices shown when you subscribe or in your order form. Enterprise pricing is set in your order form. Fees exclude taxes, which you are responsible for where applicable. AI usage billed by your own AI provider under a bring-your-own-key setup is between you and that provider.

Your data

You keep all rights to the data collected from your organization ("Customer Data"). You grant us the rights we need to host, process and display Customer Data in order to provide and support the Service.

You are responsible for having the right to collect Customer Data, including informing your developers about what the agent collects and obtaining any consents or giving any notices required by law where you operate. The data the agent collects is listed on our product page.

Acceptable use

  • Do not use the Service for anything unlawful, or to monitor people without the notices and permissions the law requires.
  • Do not attempt to access other organizations' data, probe or bypass security controls, or interfere with the Service.
  • Do not reverse engineer the Service except where the law allows it, or use it to build a competing product.
  • Do not upload malware or content you do not have the right to share.

Third-party services

The Service works with third-party products such as Anthropic, GitHub and Google. Your use of those products is governed by their own terms, and we are not responsible for them.

Intellectual property

We own the Service, the CloudByte agent and all related software and content, apart from Customer Data. If you send us feedback, we may use it to improve our products without any obligation to you.

Confidentiality

Each party will protect the other's non-public information with at least reasonable care and use it only to perform under these terms.

Disclaimers

Except as set out in a signed agreement, the Service is provided "as is" and "as available". Metrics such as ROI, hours saved and productivity multipliers are estimates intended to support your decisions, not guarantees of results.

Limitation of liability

To the extent permitted by law, neither party is liable for indirect or consequential losses, and each party's total liability under these terms is limited to the fees paid or payable to us for the Service in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

Suspension and termination

You can stop using the Service at any time. We may suspend or end access if you materially breach these terms or if needed to protect the Service or other customers. On termination, you can ask us to export or delete your Customer Data.

Changes to these terms

We may update these terms. We will change the date at the top of this page and, for material changes, notify workspace admins in advance. Continuing to use the Service after changes take effect means you accept them.
